LITIGATION, MEDIATION, AND ARBITRATION

Recourse to the courts warrants careful consideration and a close relationship between attorney and client. The decision to undertake litigation involves many factors, and is a major step. Clients often prefer to resolve claims quickly and amicably, and appreciate our effectiveness at resolving disputes through negotiation, or alternative dispute resolution. We often work with mediators or magistrate judges in resolving the disputes. When a negotiated settlement is not forthcoming, we are tenacious and resourceful litigators in federal and state courts. Once litigation commences, we keep the client informed and involved in decision making. We have helped many clients to achieve favorable outcomes, including in actions for copyright and trademark infringement. We have secured temporary restraining orders, preliminary, and mandatory injunctions. The firm successfully prosecuted a class action lawsuit, and defended a grassroots art gallery from an unwarranted eviction. We are experienced in trademark opposition actions and cancellations before the Trademark Trial and Appeal Board.

We are leaders in enforcement of federal and state visual artists' rights laws and some of our most significant cases are highlighted on the Landmark Cases subsection of this website. We have vigorously pursued major infringements and helped define how important public images should be treated. Although we are a small firm, we are respected by and have developed excellent working relationships with larger firms, and have brought some of them in as co-counsel where their resources and expertise have been tremendous assets to clients.
